Health Tourism in Türkiye: Who Is Legally Liable?

Türkiye is one of the world’s largest health tourism centres: a patient arrives with a plane ticket, has surgery within a few days and returns home. This speed compresses the medical process and also complicates the legal chain: who is liable, which court, which law?
✈️ The Parties in the Chain
In health tourism there is no single counterparty: the intermediary agency (which sells the package), the healthcare facility, the treating physician and the companies providing hotel and transfer services are separate links. The authorisation certificates of intermediary agencies and the health tourism authorisation of healthcare facilities are regulated by legislation; unauthorised intermediation and unlicensed centresTR are the riskiest side of this field. Cases focused on cosmetic surgery are covered separately in the article on cosmetic health tourismTR; the bariatric surgery side is explained in the related articleTR.
Note: Before returning home, patients usually leave with a copy of their medical file (operation note, discharge summary, images); requesting records from abroad later can prolong the process by months.
🌍 A Compressed Process: Consent, Language and Follow-up
These cases have three weak points. The first is information: consent signed in a language the patient does not understand may not meet the informed consentTR standard, which is why the interpreter record matters. The second is follow-up: an early flight and return home breaks the management of complications; the discharge planTR and the assessment of fitness to fly are part of the standard. The third is records: if the patient returns home without a copy of the medical file, proof becomes harder.
⚖️ Jurisdiction, Applicable Law and Claims
Because the treatment takes place in Türkiye, the dispute is, as a rule, heard in Turkish courts and under Turkish law; against a private healthcare facility, the consumer court route and mandatory mediation as a precondition to suit apply. Foreign patients can conduct the process remotely through a power of attorney certified by a consulate. Jurisdiction and arbitration clauses in the contract are assessed together with the provisions in favour of consumers; the damage is calculated with the relevant heads of lossTR and the physician’s compulsory insuranceTR is the counterparty in the process.
