Deportation from Türkiye: Appeal and Administrative Detention

Deportation is an administrative measure aimed at removing a foreigner from Türkiye. Legal remedies exist against this decision. This article explains deportation and the appeal process for information purposes.
🛫 What Is Deportation?
Deportation is an administrative measure that can be applied only to foreigners and that provides for the person's removal from Türkiye. In the specific cases listed in the law, the decision is made by the governorate. The decision may come up together with consequences such as the cancellation of a residence permit. For some persons, the law also provides for situations in which deportation cannot be carried out.
Note: Not missing the deadline against a deportation decision is critical to prevent a loss of rights.
⚖️ Appeal Against the Decision
Because a deportation decision is an administrative act, the person or their legal representative can bring an annulment action before the administrative court within the period set out in the law. As a rule, this action may carry an automatic suspensive effect; however, there are exceptions. Not missing the deadline is important to prevent a loss of rights.
🏛️ Administrative Detention
During the deportation process, once the conditions are met, an administrative detention decision may be issued about the person. An application can be made to the criminal judgeship of peace against an administrative detention decision; the judge concludes the review within a short time. The detention period is also subject to statutory limits. The person's rights are protected throughout the process. Each case is assessed under its own conditions.
