Divorce Abroad: Recognition and Enforcement in Türkiye

A divorce decree obtained abroad does not become valid in Türkiye automatically. For the decree to have effect in Turkish law, recognition or enforcement is required. The subject is covered in this article for information purposes.
🌍 Why Is It Necessary?
Unless a divorce decree issued by a foreign court is recognised, it is not entered in the Turkish population records, and the person may continue to appear officially married. This causes problems with remarriage, inheritance and similar matters.
📑 The Difference Between Recognition and Enforcement
Recognition allows the foreign decision to be accepted in Türkiye as a final judgment or conclusive evidence; for matters such as divorce, recognition is generally sufficient. Enforcement is needed for the decision to become enforceable (for example, for provisions requiring performance such as alimony or compensation to be carried out).
✅ General Conditions Required
- The decision must have been given by a foreign court and be final
- It must not be clearly contrary to Turkish public policy
- Reciprocity (for enforcement) and respect for the right of defence
In short: A divorce decree from abroad is not valid in Türkiye unless it is recognised. Recognition is generally enough for a divorce, while enforcement is needed for provisions requiring performance.
