Fake Crypto Exchange Scam: How It Works and the Legal Process

Fake crypto exchanges are platforms that look like a real exchange, draw in the investor’s money and shut off access at the withdrawal stage. With their unlicensed activity and deceptive operation, these schemes fall under qualified fraud.
🏦 How Does a Fake Exchange Work?
The investor is persuaded with a professional-looking interface and “profit tables”. As the investment grows, rising balances appear on screen; but when a withdrawal request is made, new payments are demanded under pretexts such as “tax”, “commission” or “account verification”, and in the end the account becomes inaccessible. The balances shown have no real backing.
🔍 Telling It Apart from a Real Exchange
- The platform is not on the list of crypto asset service providers licensed by the Capital Markets Board (SPK)
- An unknown platform recommended only by one particular person or group
- Talk of guaranteed returns and an “unmissable opportunity”
- New fees that keep appearing when money is withdrawn
Reminder: Platforms that wish to offer crypto services in Türkiye must hold an SPK licence. An unlicensed platform is not lawful.
⚖️ Legal Nature
Deception carried out through a fake exchange falls under qualified fraud under Article 158 of the Turkish Penal Code. The fact that the act is committed through computer systems and often in an organised way forms the aggravating features of the offence.
💸 Money Recovery and Blockchain Tracing
Crypto transfers can be traced on the blockchain. At the point where the money reaches a licensed exchange, account suspension and seizure measures may be applied. A precautionary injunction and the return-to-victim mechanisms in the criminal case are assessed together; early intervention is critical for tracing the money.
