💰 Is a Forex Refund Possible?
Yes. Recovering money lost to illegal forex fraud is possible in many cases. Because most of the money is transferred to bank accounts or crypto wallets in Türkiye, it can be traced. For a refund, not just one route but several legal routes, chosen according to each case, are pursued together. What is decisive is how the payments were made, where the money went, how complete the evidence is and how quickly action is taken.
🔍 What Is Forex Fraud and How Does It Work?
Forex fraud is when fake “brokerage firms” operating without SPK permission persuade investors with promises of high profits and take their money by deception. The way it works follows almost the same pattern in every case:
- First contact: The victim is reached through a social media advertisement, a “would you like to earn money” form, or a direct phone or WhatsApp call.
- Trust stage: It starts with a small investment, profits are shown on screen, and trust is even reinforced by paying out a small withdrawal.
- Escalation: Under pressure that “the opportunity is slipping away”, larger amounts are deposited; in fact no real investment is made and the figures on screen are fake.
- Withdrawal block: When a withdrawal is requested, extra payments are demanded under pretexts such as tax, commission, “lot conversion” or a system error; the process continues until the person is exhausted.
- Threats and stalling: The victim is frightened with claims such as “you carried out an illegal transaction, you will be punished too”. This is merely a tactic to prevent a complaint.
🚩 How to Tell an Illegal Forex Firm
Whether a forex firm is legal can be established through three basic checks: the SPK licence, the Takasbank account and the company type. The table below gives a quick checklist:
| Check | Legal Firm | Illegal / Fake |
|---|---|---|
| SPK Licence | Appears on the official list of brokerage firms kept by the Capital Markets Board (SPK) | Not on the list; “it has a foreign licence” is claimed |
| Takasbank Account | A separate Takasbank account is opened for each investor (visible through e-Devlet, the Turkish e-government portal) | There is no Takasbank record |
| Company Type | Must be a joint-stock company | Accounts of unrelated companies, such as textile or computer firms, are used |
| Money Transfer | Corporate, transparent and registered | Payment is requested to an individual or company account, or to a crypto wallet |
Whether a firm is on the SPK list of authorised firms can be checked on the SPK brokerage firms page, and a Takasbank record can be checked through e-Devlet.
⚖️ Legal Routes for Getting Your Money Back
In forex fraud there is no single route to a refund; depending on the case, one or several of the routes below are pursued together.
| Method | What It Does | Key Feature |
|---|---|---|
| Criminal Complaint to the Prosecutor’s Office | Starts a criminal investigation for qualified fraud | Helps identify the perpetrator and the accounts |
| Precautionary Attachment (Freezing Order) | Places a block on the other side’s assets and accounts without their knowledge | The fastest protection; prevents assets being moved away |
| Enforcement Proceedings | Opens proceedings to collect the claim on the basis of the payment receipt | Possibility of attachment if no objection is raised |
| Claim for Payment | Requests the return of the money sent from the court | A definitive result on the merits |
| Chargeback (Reversal) | A refund request to the bank for credit/debit card payments | The most practical route for card payments |
Of these routes, the two strongest are usually the precautionary attachment and enforcement proceedings; the aim is not merely a right on paper but getting the balance back by actually placing a block on the accounts of front companies and individuals. Which route is chosen depends on the method of payment, the trail of the money and the state of the evidence.
📌 Penalties for Forex Fraud
Illegal forex transactions are treated as qualified fraud under the Turkish Penal Code and are tried before the high criminal court. Depending on the nature of the case, additional offences may also arise:
| Offence | Law | Sanction |
|---|---|---|
| Qualified fraud / fraud through information systems | Article 158 of the Turkish Penal Code | Imprisonment + judicial fine (high criminal court) |
| Unauthorised capital markets activity | Articles 109–110 of the Capital Markets Law | Imprisonment + judicial fine |
| Laundering of proceeds of crime (money laundering) | Law No. 5549 / Article 282 of the Turkish Penal Code | Imprisonment + judicial fine |
Important: A person who invests in an illegal platform does not commit an offence; on the contrary, they are the victim of the fraud. The threat that “you will be punished too” is aimed only at discouraging a complaint.
🪙 Forex Fraud Carried Out with Crypto
To make the trail harder to follow, scammers often ask for payment in cryptocurrency (usually USDT) and steer victims with promises such as a “bonus”. But crypto also leaves a trail: through wallet addresses and transaction IDs (TXID/hash), the recipient can be identified through the prosecutor’s office. Platforms such as Binance, Paribu and BTC Türk are lawful crypto exchanges; in these cases they are merely a conduit for the transfer. For those who paid in crypto, the records usually needed are wallet addresses, TXID records, and screenshots of exchange transfers and withdrawals, so these are worth preserving.
🌍 Victims of Foreign-Based Forex Platforms
Although firms often present themselves as “based in Cyprus/the UK”, the money arrives in bank accounts or crypto wallets in Türkiye; in other words, the appearance of being foreign is often a qualified lie. In such cases, chargeback for card payments comes to the fore, and so do a criminal complaint and enforcement/attachment routes where the money trail leads to Türkiye. In cases with a foreign element, identifying the right jurisdiction and method directly affects the result.
⏳ Limitation Periods and Key Deadlines
In illegal forex fraud, the limitation period under qualified fraud is 15 years. By contrast, chargeback deadlines for card payments are much shorter; for this reason, where payment was made by card, action needs to be taken without losing time.
| Subject | Period |
|---|---|
| Limitation period for qualified fraud | 15 years |
| Maximum chargeback limit (card transaction) | At the latest 540 days from the date the transaction is posted to the card |
| Chargeback application window (most dispute types) | Generally 120 days |
🛡️ Points to Note During the Process
- Evidence is not deleted: The originals of receipts, WhatsApp/Telegram messages, platform screenshots and crypto records are usually kept.
- No new payments are made: Anyone who says “pay tax/commission and you can withdraw your money” or promises a “guaranteed refund” is typically a continuation of the same scheme.
- The “let us get your money back” trap: Fake “refund/consultancy” people who target victims a second time are a known risk.
- Threats carry no legal weight: Investing does not make a person a criminal; a person can seek their rights as a victim.
- Speed: The earlier the process starts, the better the chances of blocks being placed on accounts and of a refund.
