Administrative Detention and Objections for Foreigners

During the deportation process, an administrative detention decision may be issued in respect of some foreigners. Because this decision restricts personal liberty, it is subject to strict safeguards. This article explains administrative detention and the objection process for information purposes.

🏛️ What Is Administrative Detention?

Administrative detention is a measure under which foreigners who are subject to a deportation decision and who pose a flight risk, or who meet certain other conditions, are held in removal centres. It is an administrative measure, not a punishment. Its purpose is to secure the process. Its use depends on specific conditions.

Note: The main safeguards are that administrative detention does not exceed a reasonable period and that it is reviewed regularly.

🗓️ Duration and Review

The duration of administrative detention is limited by law and is reviewed at regular intervals. Where the conditions no longer exist, the detention is ended; in some cases, lighter measures may be applied instead of detention. Not exceeding a reasonable period is a basic safeguard. Throughout the process, the person's rights are protected.

⚖️ The Objection Route

Against an administrative detention decision, the person or their legal representative can apply to the criminal judgeship of peace; no time limit is set for this application. The judge concludes the review within a short time. A new application is also possible when circumstances change. This safeguard is also linked to international protectionTR processes. Each case is handled under its own circumstances.
