C-113 Restriction Code in Türkiye: Illegal Entry or Exit Ban

The Ç-113 (C-113) restriction code is entered in the record of foreigners who enter Türkiye or leave Türkiye by illegal means, or attempt to do so. In practice it is known as a two-year entry ban, and in most cases it comes with an administrative fine.
In short: Entry and exit must take place through border gates with a valid passport (Law No. 6458 on Foreigners and International Protection, Art. 5). A breach of this rule is both a ground for deportation (Art. 54/1-h) and a ground for an administrative fine (Art. 102/1-a). If the fine is not paid, an unpaid-fine code may also be added to the record.
What this article covers
Note: There is no official definition list for the Ç-113 code; the two-year period is the meaning that has settled in the practice of the Presidency of Migration Management and is reported in the same way by several professional sources. The exact period in a person's record has to be verified separately.
🔎 What Does the Ç-113 (C-113) Restriction Code Mean?
The code is used for foreigners who enter outside a border gate, by irregular routes or without a valid document, who leave the country in the same way, or who are caught attempting to do so. Entries made with forged documents may be assessed separately under their own code. Ç-113 is tied not to the length of a violation but to the manner of entry or exit; in this respect it differs from the overstay codes.
📜 Legal Basis
- Law No. 6458, Art. 5: Entry into and exit from Türkiye take place through border gates with a valid passport or a document replacing a passport.
- Art. 54/1-h: A deportation decision is taken against people who breach, or attempt to breach, the legal entry or exit provisions.
- Art. 56/1: People who breach the legal entry or exit rules are not given a period to leave the country voluntarily; deportation is applied directly.
- Art. 9/2 and Art. 9/3: An entry ban is imposed on a deported foreigner; the ban lasts at most five years.
🛡️ People Who Apply for International Protection
The law contains an important safeguard for people who arrive by irregular routes while fleeing persecution or a risk of serious harm. Under Art. 65/4 of Law No. 6458, no penal action is taken for breach of the legal entry conditions against people who apply for international protection to the governor's office on their own initiative within a reasonable time, provided that they explain the valid reasons for their illegal entry or stay. This safeguard depends on the application being made without delay and on the reasons being explained. The types of international protection are described in the article on refugee, conditional refugee and subsidiary protectionTR.
🧾 Fines and Additional Codes
Art. 102/1-a provides for an administrative fine for foreigners who enter Türkiye illegally, leave Türkiye illegally, or attempt to do so. Fines are paid within thirty days of notification (Art. 102/5); for a repeat within one calendar year, the fine is increased by half (Art. 102/3). If the person leaves the country without paying, an unpaid-fine code may also be added to the record; the consequences of this are covered in the article on the Ç-135 (C-135) restriction code.
⚖️ Objection and Lifting
- An action against the deportation decision is filed with the administrative court within seven days of notification (Art. 53/3). Details: deportation and objectionTR.
- An annulment action against the entry ban can be filed within sixty days under Art. 7 of the Administrative Procedure Law (İYUK).
- Against the administrative fine, an application to the criminal judgeship of peace is open under the general rules on misdemeanours.
- While the ban continues, the Directorate General may allow entry for a limited period (Art. 9/6); in practice this is the process known as the annotated visa (meşruhatlı vize).
