G-82 Restriction Code Turkey: Activity Against National Security

The G-82 restriction code is an entry-ban code applied when a foreign national is assessed to be engaged in activity against national security. It carries a narrower and heavier description than G-87: it is not a general risk, but an allegation of activity directly aimed at the security of the state.
In short: The basis of G-82 is Article 9/1 and Article 54/1-d of Law No. 6458. The code is usually applied together with a long-term ban. In judicial review, the administration may withhold documents on national security grounds; however, a decision cannot be based on a document that has not been submitted (Article 20/3 of the Administrative Procedure Law, İYUK).
What this article covers
Note: The national-security meaning given to G-82 is settled in practice. However, the list of codes is not a publicly available legislative text, and the content of the specific allegation must be examined in each case.
🔎 What Does the G-82 Restriction Code Mean?
G-82 is entered in the record when there is an assessment that a foreign national is, or may be, engaged in activity against the national security of Türkiye. The assessment is usually based on information passed to the Presidency of Migration Management by the relevant security units. In the notification served on the foreign national, often only the article of the law appears; the facts of the case come to light only through the administration's defence during the court process.
⚖️ The Difference Between G-82 and G-87
G-87 refers to a general security risk, while G-82 refers to activity against national security. The practical difference appears in two points. First, because the allegation under G-82 is more specific and more serious, the administration is expected to rely on a fact that supports it. Second, national security is the area in which the confidentiality exception under Article 20/3 of İYUK is applied most often; the discussion about submitting documents is therefore more prominent in G-82 cases.
📜 Legal Basis
- Law No. 6458, Article 9/1: Foreign nationals whose entry is considered undesirable for public order or public security may be banned from entry.
- Law No. 6458, Article 54/1-d: A deportation decision is taken against those who pose a threat to public order or public security.
- Law No. 6458, Article 9/3 and Regulation Article 8/2-d: Five years, and a further ten years in the case of a serious threat; an upper limit of fifteen years in total on the same ground.
⚠️ Consequences and Duration
While G-82 is in force, no visa is issued (Article 15/1-c) and the person is turned back as an inadmissible passenger (Article 7/1-c). The residence permit of a foreign national who is in Türkiye may be cancelled (Article 33/1-ç) and deportation proceedings may be started. In practice, this code is seen with durations close to the upper limits in the Law, together with the possibility of extension.
Even where a deportation decision is taken, if there are serious indications that the person would face the death penalty, torture, or inhuman or degrading treatment in the country of destination, the provisions of Article 4 (non-refoulement) and Article 55 of Law No. 6458 are assessed separately.
⚖️ Legal Remedies
- Against the entry ban: an annulment action before the administrative court within sixty days of notification (İYUK Article 7).
- Against the deportation decision: seven days from notification; the court decides within fifteen days and its decision is final (Law No. 6458, Article 53/3).
- Administrative application: the Presidency may lift the ban or allow entry for a limited period (Article 9/6).
National security is the ground on which the confidentiality exception in Article 20/3 of İYUK is relied on most often. The President, the relevant Vice President or the minister may decline to give the court documents concerning the security or higher interests of the state, by stating the reason. However, the Law also sets the price of this: the administration cannot base its defence on a document it has not submitted to the court, and the court cannot decide on the basis of such a defence.
