O-100 Restriction Code Türkiye: Withdrawn Protection Claim

The O-100 restriction code is applied to foreigners who withdraw their international protection application or whose application is treated as withdrawn. Sources describe it as a one-year entry ban. The code is seen especially in cases where the applicant left their registered address, did not meet the reporting obligation and was considered to have disappeared.
In short: Article 77 of Law No. 6458 lists the situations in which an application is treated as withdrawn. In that case the assessment is stopped; if the person has no right to stay in Türkiye under other provisions of the Law, a deportation decision is taken (Art. 54/1-i) and an entry ban comes into play. O-100 is the record of this process.
What this article covers
Note: Codes in the O group relate to international protection processes. Although the meaning of O-100 and the one-year period are reported in the same way by several sources, no official list of codes has been published.
🔎 What Does the O-100 Restriction Code Mean?
A person who applies for international protection has the right to stay in Türkiye until the application is concluded; however, this right depends on certain obligations. If the applicant does not meet these obligations or withdraws the application themselves, the process is stopped and the right of stay that protection provides ends. O-100 is the record of this situation and of the ban linked to it. For the types of international protection, see the article on refugee, conditional refugee and subsidiary protectionTR.
📋 Situations Where an Application Is Treated as Withdrawn
Under Article 77/1 of Law No. 6458, an application is treated as withdrawn and the assessment is stopped where the applicant:
- declares in writing that the application is withdrawn,
- fails, without an excuse, to attend the interview three times in a row,
- escapes from the place where they are held under administrative detention,
- fails, without an excuse, to meet the reporting (signature) obligation three times in a row, does not go to the designated place of residence or leaves it without permission,
- objects to the taking of their personal data,
- fails to comply with their obligations during registration and the interview.
In practice, the most common reason is leaving the province assigned to the person without permission and missing the reporting (signature) obligation.
⚠️ Consequences
- Deportation: Art. 54/1-i provides that a deportation decision is taken for persons whose application is withdrawn or treated as withdrawn and who, after the final decision, have no right to stay in Türkiye under other provisions of the Law.
- Entry ban: The entry of a deported person is banned under Art. 9/2; sources report a one-year period for O-100.
- Cancellation of the work permit: The permit of a person who obtained a work permit as an applicant is cancelled, upon notification by the Ministry of the Interior, when the application is withdrawn or treated as withdrawn (Art. 17/5-a of Law No. 6735).
If the applicant has a right to stay in Türkiye on another basis, for example a family residence permit, the deportation condition is not met; Art. 54/1-i makes this distinction expressly.
🔁 Re-applying
A person may later wish to submit a new international protection application. However, under Art. 72/1-a, the application of a person who repeats the same application without presenting a different ground is treated as inadmissible. A new application therefore requires a new element that arose after the previous application to be clearly demonstrated.
⚖️ Objection and Lawsuit
- Decisions taken under international protection can be objected to before the International Protection Evaluation Commission within ten days of notification (Art. 80/1-a). Against inadmissibility decisions, only the judicial route is open, and the period is fifteen days (Art. 80/1-ç).
- Other administrative decisions and acts can be challenged before the administrative court within thirty days of notification (Art. 80/1-ç).
- A seven-day period for filing a lawsuit applies against a deportation decision (Art. 53/3). Details: deportation and objectionTR.
- Documenting the excuse (such as illness, lack of notification, or the address having been notified to the authorities) is decisive when seeking to have the decision treating the application as withdrawn cancelled.
