Forex Fraud Criminal Complaint Process in Türkiye

The criminal side of forex fraud is often set in motion by a criminal complaint or a report. This section explains, for information purposes, what a criminal complaint is and how an investigation generally works.
📌 What Is a Criminal Complaint?
A criminal complaint is the notification of the competent authorities that an offence has been committed. Because forex fraud falls under qualified fraud, it does not require a complaint (it is prosecuted ex officio); that is, the Chief Public Prosecutor's Office opens an investigation on its own as soon as it learns of the offence.
🔄 How Does the Investigation Work?
During the investigation, the flow of money is examined, account records are assessed and steps are taken to identify the perpetrators. At this stage, protective measures such as seizure and suspension of accounts may come into play.
Speed matters: The earlier the process starts, the greater the chance that the money is still in an account that can be traced.
🙋 The Position of the Victim
A person who has suffered loss through deception is the victim of the offence and can take part in the investigation and prosecution as a complainant / intervening party. This status allows the victim to follow the proceedings and assert their rights.
⚖️ After the Investigation
If sufficient evidence is found at the end of the investigation, a public prosecution is brought and the trial continues before the High Criminal Court (assize court). A civil action can also be pursued separately to recover the loss.
